JUDICIAL PROTECTION AGAINST PROCEDURAL OMISSIONS AND UNJUSTIFIED OMISSIONS

Annotation

In this presentation an attempt has been made to provide an answer to the following issues:

1. Shall omissions of the administrative body be an object of judicial review when they represent a part of the proceeding for the issuing of an administrative act /procedural omissions/ and which within the meaning of Art. 21, Para. 5 of the Administrative Procedure Code are not individual administrative acts?

2. Is it possible for this judicial review to be exercised under Section II of Chapter 15 of the Administrative Procedure Cod, regulating the litigation of unjustified omissions, and in which cases? In this connection the relevant jurisprudence has been analysed.
