Annotation

Non discrimination is a fundamental right and principle of law. The exercise of rights must be ensured equal opportunities. In the surrounding world there are de facto inequalities. They require special treatment by the law. The need for аffirmative action  can be sought in different values - general well-being, access to rights, tolerance, equality, tolerance, etc.

They have their political origins. The implementation of аffirmative action  have their source in international law.  On the other hand the nation state implements and controls the implementation of positive measures.  This leads to the question of the constitutionality of affirmative action.
