ADMINISTRATIVE AUTHORITIES AS PROVIDERS OF ELECTRONIC ADMINISTRATIVE SERVICES

Annotation

Thе present article examines the concept of administrative authority in terms of administrative service activities, incl. electronic administrative services. The specifics of the definitions for administrative authority are outlined according to § 1, item 1 of the additional provisions of the Bulgarian Electronic Governance Act and § 1, item 1 of the additional provisions of the Administrative Procedure Code. Furthermore, the difference in the nature of the concepts of executive authority and administration /administrative structure/ is considered in regard of obligations for providing electronic administrative services. In addition, this article addresses issues related to the delegation of power/competence /"law-based empowerment"/ in the sense discussed in the present article. A conclusion is drawn about the need for an expansive interpretation of the concept of executive authority for the purpose of applying the provisions of the E-Governance Act, as well as "holder of administrative competencies, empowered on the basis of an Act" should be understood as administrative structures outside the system of the executive /private parties/.
