Annotation

Subject of critical analysis of this paper is the legal framework regulating the issuance of designation orders for national parks, their entry into force and their litigation. Given that in national parks nature is the subject of protection and that by designating a protected area, a national park in particular, constitutionally proclaimed values are secured, the importance of the questions raised is indisputable. However, there is another side to these issues, namely the right of the people to benefit from the natural resources. This is why the regulation of the society-nature relationship should be clear and consistent, which has not been achieved as at the moment.
