The articlesets out the main features of the institutes of incompatibility and conflict of interest, and the elements of Art. 5 of the Law on prevention and detection of conflicts of interest. A comparative legal analysis of the two institutes is presented. The differences between the two legal phenomena are marked, with a view to factual constituents, duration in time, procedure for detection, implications, and other features. The author arrives at the conclusion that although different in their content, incompatibility and conflict of interest are in essence related and interdependent.
