The article examines аrt. 3, para. 2 of the Administrative Violations and Sanctions Act. According to the cited provisionif by the time of entry of a penal decree into force other normative acts have ensued, applicable shall be the one that is deemed more favourable to the offender. The article analyzes the nature of that rule, its application, and the issues of its non-application or application.
