The article focuses on the questions: who, when and how can amend the indictment. It is stated that, in principle, only the public prosecutor is entitled to amend the indictment, but one exception to the rule is indicated - Article 287, paragraph 5 of the Criminal procedure code of Bulgaria. It is noted that amendment of the indictment is allowed only at the stage of "Judicial investigation" before the court of first instance. The procedure for amending the indictment is marked and several important legal consequences are shown by the author.
The author refers to 32 judicial acts from the practice of the Supreme Court of Cassation and the Supreme Court.
