THE SIGNIFICANCE OF GUILT FOR THE ADMINISTRATIVE LIABILITY OF LEGAL ENTITIES

Annotation

The administrative liability of legal entities, regulated in the Administrative Violations and Penalties Act is qualified as objective. However, this does not automatically mean that guilt issues have nothing to do with this responsibility. This is because legal entities act through their representatives, who are necessarily people, individuals who may or may not be guilty. At the same time, there are significant differences in the regulation in art. 83 and 83a of the Administrative Violations and Punishments Act as to the impact of the quilt upon the corporate administrative liability and the exclusionary circumstances connected with it.
