In my previous publication (see Did the EU Court refuse to respect the Bulgarian national constitutional identity?) I analyzed some features of the decision of the Court of the European Union (CJEU) in the Pancharevo case[1], related to the national constitutional identity. However, the same decision raises another round of significant questions related to the understanding of the scope of European Union (EU) law and the meaning of the framework of competences granted to the EU - and in this sense, the question of the sovereignty of the Member States (MS).
