Annotation

In 2023, the National Assembly adopted amendments and additions to the Constitution of the Republic of Bulgaria. One of the amended provisions empowers the courts to refer to the Constitutional Court. The constitutionality of the Law on Amendments and Supplements to the Constitution is the subject of two constitutional cases, on which at the time of presentation of this statement the Court has not ruled, therefore the new provision of Art. 150, para. 2 of the Constitution (KRB) is in effect and the courts in the country have started to exercise the new authority granted to them and to submit to the Constitutional Court (CS) requests to establish the inconsistency of (a provision of) a law with the Constitution.
