Annotation
This article aims to prove the thesis that the punishment for a crime within the meaning of the Penal Code is a function of the principle of justice. The theoretical foundations in the study of the thesis include the consideration of the following issues: 1) Predictability of punishment through the prism of the principle of justice in the Penal Code; 2) Comparative legal aspects between the two categories: punishment and justice; 3) Legal technique for formulating a fair punishment in the sanction part of criminal law norms.
