The scientific article aims to examine the problem of the essence and scope of the regulatory function of criminal law. The individual aspects of this problem emphasise the thesis regarding the legal possibilities for changing the subject of the regulatory function. The theoretical foundations of this exposition include questions concerning; 1) The manifestation on the principle of legality the principle of legality in contemporary criminal law; 2) The legal mechanisms for changing the subject of the regulation of social relations. The issue under consideration has been researched on the basis of the dialectical method, which reflects the phenomena in the development of society in accordance with the theoretical foundations of criminal law science regarding the doctrine of crime.
