MEDICAL STANDARDS IN BULGARIAN HEALTH LEGISLATION: A NECESSARY TOOL FOR ENSURING QUALITY MEDICAL CARE

Annotation

The creation of an effective health system, in which the health rights of citizens are guaranteed to the highest degree, is becoming an increasingly difficult task for all European countries, given the contemporary challenges in the field of public health. Despite the existence of a number of new health risks, national authorities have an obligation to create adequate mechanisms and instruments to ensure the health of citizens as a state of complete physical, mental and social well-being. The first step of these authorities should be the adoption of appropriate national legislation, which includes not only health laws, but also by-laws. In this regard, an important part of the by-laws in the Republic of Bulgaria are the medical standards, which define the minimum requirements for safety, quality and effectiveness of medical care. Despite the essential importance of the aforementioned standards, there has been a systematic problem in the country for years with their adoption and implementation, which unfavorable phenomenon creates prerequisites for legal uncertainty and for the violation of the patient's right to accessible and high-quality medical care. This report will analyze the legal framework and the essence of medical standards, as well as the serious legal consequences of their absence in Bulgarian legislation.
