Annotation
The essence of franchise and legal characteristics of the franchise agreement are discussed, as well as the qualifications offered by the legal doctrine and the commercial practice. In the report a distinction is franchised with similar trade contracts is made. Sources of legislation into national law and European law are identified. Issues of protection of intellectual property rights provided by the franchisor and clarified the legal means of defense in case of violation are discussed. Attention is given to the most common conflicts in relationships and in connection with the termination of the franchise agreements. Studied is rich jurisprudence relevant to the subject matter, including competition law.
