Annotation

The present article discusses the controversial question in the practice about the scope of the right of priority satisfaction under Art. 136, par. 1, section 1 of the Contracts and Obligations Act which is subject of interpretative case No. 2/2021 of GACCC of the SCC (the General assembly of the Civil and Commercial Chambers of the Supreme Court of Cassation).
