GENERAL CHARACTERISTICS OF THE JUDICIAL PROCEDURE FOR ESTABLISHING OF WORK AND/OR RETIREMENT SERVICE

Annotation

This scientificanalysis addresses the general characteristics of claim proceedings for establishing of employment and retirement service. The author focuses on the particularities of this legal procedure.

A distinction is madebetween claim proceedings for the establishment of employment and/or retirement service, and the certification protective proceedings for the establishment of facts under Chapter fifty (Art. 542 to 548) of the CPC.

Since theLaw on establishment of work and retirement service by court order provides for two distinct and separate declaratory actions – action for establishing of work service and action for establishing of retirement service, the author considers the possibility that the two claims are brought together for joint consideration in one court procedure.
