Annotation

The article aims to answer a question, rarely studied in our legal theory, namely: what are legal limits of judicial review of legality of the dismissal in art. 344, s. 1, subs. 1 of Labor Code suits for overturning unlawful dismissals. Particularly, whether the court, without specific invocation by the employee to find vices of the dismissals in order find meritorious the art. 344, s. 1, subs. 1 of Labor Code suit. This is a question in with Supreme Court of Cassation of Bulgaria’s case-law has underdone complete turnabout. This turnabout merits an essay for theoretical interpretation and reasoning.
